In late July, US District Judge Haywood Gilliam granted "preliminary approval of the class action settlement ... and the settlement plan of allocation" filed in the California federal court by plaintiff Patrick Hendrick, who claimed tuna giant Starkist underfilled its cans, according to court documents.
Hendricks reportedly conducted independent testings of StarKist tuna and allegedly found cans contained less than stated on the label. His lawsuit stated StarKist falsely claimed its 5-ounce cans of tuna contain an adequate amount of tuna when, in reality the cans allegedly are substantially underfilled.
