In her witness statement, Ngoc-Tram Nghiem alleged unlawful deduction from wages by employer China Export Finance Ltd. after being told in August 2007 she would not receive an annual bonus.
On Wednesday, Holyoake read a witness statement to the tribunal panel in which he said there was no contractual obligation to pay the “discretionary” bonus.
Holyoake owns 60 percent of China Export Finance, which shares offices with British Seafood and utilizes some central functions on a recharge basis but is not associated with the company in a legal sense, he said.
