The decision by Judge Hollis Hill upholds a November verdict against Seattle-based Icicle for an injury suffered to Dana Clausen in a 2006 vessel processing accident in which Clausen suffered back and neck injuries.

The jury in that case awarded Clausen $1.5 million (€1.1 million), of which $1.3 million was punitive damages for what the jury called the company's deliberate refusal to call for medical assistance for the injured worker.

The company appealed, saying the punitive damage award was too high and out of line with the compensatory damages of $200,000 (€146,300) that were awarded.
