Shrimp processor Heiploeg has failed to get a European cartel fine of €27 million ($30.4 million) off the table, reportedFD.nl.

The general court of the European Union's second highest court rejected an appeal against the fine on Tuesday.

Heiploeg, which was fined €27 million in November 2013 for its involvement in a European shrimp cartel, went bankrupt at the beginning of 2014 but relaunched almost immediately as Heiploeg International after a takeover by Parlevliet & Van der Plas (P&P).

The company argued in its appeal that the European Commission, which oversees fair competition within the EU, has used secret recordings to cement its case, which according to Heiploeg's lawyers have been obtained unlawfully.
