A class-action suit has been brought against Chicken of the Seat, Bumble Bee Foods and StarKist by a group of US consumers claiming the company's "dolphin safe" labeling is misleading and fraudulent.

The two groups of consumers, from Florida, California and New York among other places, say that despite the two companies claiming since 1990 that all of their tuna products are "Dolphin Safe," with the use of a Dolphin Safe logo, they continue to use fishing practices, including longlines and fish aggregating devices (FADs) that injure or kill dolphins.
