The US Food and Drug Administration (FDA) is appealing a lower court's ruling that ordered the agency to reevaluate the environmental impacts of salmon producer AquaBounty's AquAdvantage GM salmon.

In a decision last November, Vincent Chhabria, US District Judge for the Northern District of California, ruled the FDA did not "meaningfully analyze what might happen to normal salmon in the event the engineered salmon did survive and establish themselves in the wild," nor did it consult with NOAA agencies, in potential violation of the Endangered Species Act.
