Tennessee-based law firm Stewart, Estes and Donnell said Wednesday several reports alleged current or former restaurant managers at Long John Silver's were wrongfully denied overtime pay.
Under the U.S. Fair Labor Standards Act, the law firm noted, salaried managers are exempt from overtime pay only if they are paid on a " salary basis," as defined by FLSA regulations. A salaried, exempt employee receiving a predetermined amount cannot be subject to reductions in their pay due to variations in the quality of the job they perform, the law firm said.
