A US District Judge in Massachusetts is allowing a class action lawsuit over Gorton's deceptive sustainability marketing for its tilapia to move forward, despite industry groups stepping forward to vouch for the company.

At a hearing on Aug. 11, Gorton's acknowledged that "some of its tilapia comes from fish farms in China but contended that it follows industry best practices in its sourcing from China," according to court documents.

The Global Seafood Alliance and New England Aquarium also submitted an amicus brief to support Gorton’s motion to dismiss arguing that Gorton’s uses credible third-party certification to ensure industry best practices.
