Asking a candidate about whether they have been vaccinated as part of an employer’s recruitment process is risky as protection against unlawful discrimination under the Equality Act also covers prospective employees.

Therefore, asking such a question could amount to discrimination if the individual has not had the Covid-19 vaccination as a result of, for example, their religious or philosophical beliefs, a disability or any other relevant “protected characteristic."
